The compromise legislation that will now be sent to Governor George Pataki for his signature is an amendment to the existing law that established RIOC. Below, CAPITALIZED material represents new content, while material in braces { } will be removed from the existing law.

1 Section 1. Chapter 899 of the laws of 1984, relating to creating a
2 public benefit corporation to plan, develop, operate and maintain and
3 manage Roosevelt Island, is amended by adding a new section 10-a to read
4 as follows:
5 S 10-A. OPEN SPACE DEVELOPMENT PROHIBITED. NOTWITHSTANDING ANY OTHER
6 PROVISION OF THIS ACT, OR ANY OTHER LAW TO THE CONTRARY, ON OR AFTER THE
7 EFFECTIVE DATE OF THIS SECTION, NO FURTHER DEVELOPMENT OR CONSTRUCTION
8 FOR OTHER THAN PARK PURPOSES SHALL BE PERMITTED ON ANY REAL PROPERTY
9 WHICH IS IDENTIFIED AS OPEN SPACE AREAS IN THE GENERAL DEVELOPMENT PLAN
10 AS AMENDED MAY 10, 1990 AND APPROVED BY THE BOARD OF ESTIMATE OF THE
11 CITY OF NEW YORK ON AUGUST 17, 1990 AND REFERRED TO IN THE LEASE DEFINED
12 IN SUBDIVISION SIX OF SECTION TWO OF THIS ACT, AND ON SUCH REAL PROPERTY
13 SHALL REMAIN OPEN SPACE AREAS FOR THE DURATION OF THE LEASE UNLESS SUCH
14 DEVELOPMENT OR CONSTRUCTION INCLUDES THE RECONSTRUCTION, RESTORATION,

1 REHABILITATION OR PRESERVATION OF THE HISTORIC LANDMARKS LOCATED IN SUCH
2 OPEN SPACE AREAS AND FURTHERS THE USE OF THE AREAS SURROUNDING THE
3 HISTORIC LANDMARKS AS OPEN SPACE AREAS. OPEN SPACE AREAS, AS USED IN
4 THIS SECTION SHALL BE LIMITED TO LIGHTHOUSE PARK, OCTAGON PARK, BLACK-
5 WELL PARK, AND SOUTH POINT PARK.
6 S 2. Subdivision 2 of section 3 of chapter 899 of the laws of 1984,
7 relating to creating a public benefit corporation to plan, develop,
8 operate and maintain and manage Roosevelt Island, is amended to read as
9 follows:
10 2. The board of directors of the corporation shall be composed of nine
11 members. One member shall be the commissioner, who shall serve as the
12 chairman and chief executive officer of the corporation; one member
13 shall be the director of the budget; and seven public members shall be
14 appointed by the governor with the advice and consent of the senate. Of
15 the seven public members, two members, one of whom shall be a resident
16 of Roosevelt Island, shall be appointed upon the recommendation of the
17 mayor of the city; and {two} FOUR additional members shall be residents
18 of Roosevelt Island. Each member shall serve for a term of four years
19 and until his successor shall have been appointed and shall have quali-
20 fied, except that (a) two of the initial public members appointed by the
21 governor, one of whom is a resident of Roosevelt Island, and the Roose-
22 velt Island resident member appointed upon the recommendation of the
23 mayor of the city shall serve for terms of two years each, and (b) the
24 commissioner and the director of the budget shall serve so long as they
25 continue to hold their respective offices. Any action taken by the
26 directors of the corporation shall be taken by majority vote of the
27 directors then in office. The elected public officials who represent
28 Roosevelt Island shall be representatives to the board of directors of
29 the corporation entitled to receive notice of and attend all meetings of
30 such board but shall not be entitled to vote. Failure to give such
31 notice shall not effect the validity of any action taken at a meeting of
32 such board.
33 S 3. This act shall take effect immediately.
